Our practice includes a wide range of disciplines, our lawyers having experience in litigation and corporate work involving, amongst others, commercial, insolvency, corporate restructuring, schemes of arrangement, information technology, joint ventures, sale and purchase of shares and assets, receivership and construction. Each matter is given individual and unique attention. Solutions are client-oriented, and are customized for each individual client and matter, both contentious and non-contentious.

At hky, our essential sustaining element is litigation. We are an exception to the myth that lawyers who fight matters in court are hostile and unapproachable. Far from that, we communicate effectively, we are persuasive, we have excellent interpersonal skills, traits that we hold in high regard, especially when we explain our fee system to our clients.

Highlights

Corporate/Commercial Disputes

  • Acted in numerous director/shareholder disputes involving companies listed in the Malaysian Stock Exchange.
  • Acted for a party defending a claim involving an asset recovery exercise based on allegations of international fraud and money laundering.
  • Acted for an advocate and solicitor of the High Court of Malaya in defending a claim on a breach of trust.
  • Acted for a major insurance company in resisting a claim on a collapse of a building, making way for a prospective change in the law on the interpretation of specific terminologies used in the industry.
  • Acted for a property developer in resisting and setting aside a pre-emptive freezing order and in defending a claim for specific performance and the recovery of damages for late delivery of properties.

Administrative Law

  • Acted for a celebrated remisier in a judicial review of reprimands imposed by the Malaysian Stock Exchange.
  • Acted for an officer of a telecommunications company in a judicial review who was unceremoniously dismissed from his position in office.
  • Acted for purchasers of a high-rise apartment in the capital city in a judicial review of decisions of the DBKL affecting its development.

Public Interest Litigation

  • Acted for several prominent opposition leaders involving unlawful arrest/detention and defamation by the police, resulting in a landmark award of damages paid by the Government of Malaysia.
  • Acted for Suara Rakyat Malaysia (Suaram) in a major defamation lawsuit against the New Straits Times, resulting in the subsequent release of a public apology in the national daily itself.
  • Acted for a prominent opposition leader in a defamation lawsuit instituted by FELDA.
  • Acted for the family of a government officer who died while in the custody of the MACC.
